In no event shall GetPestFixed's total liability to you for all claims arising from or relating to these Terms or your use of the Site exceed the amount you paid to GetPestFixed, if any, during the twelve (12) months preceding the event giving rise to liability.

11. Indemnification

Class Action Waiver: You agree that any arbitration or legal proceeding shall be conducted only in your individual capacity and not as a class action, collective action, or other representative proceeding. The arbitrator shall have no authority to conduct class-wide arbitration proceedings. This class action waiver is an essential part of these Terms and may not be severed.

Opt-Out Provision: You have the right to opt out of this arbitration agreement by sending written notice of your decision to opt out to info@getpestfixed.com within thirty (30) days of first accepting these Terms or any subsequent changes to these Terms. Your notice must include your full name and a clear statement that you wish to opt out of the arbitration agreement.

Exceptions: Notwithstanding the foregoing, either party may bring an individual action in small claims court, seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights, or seek to enforce these arbitration provisions.
